1. Introduction 

The website www.alliednewspapers.com.mt (the “Website”) is owned and operated by Allied Newspapers Limited, a company registered in Malta under company number C308 with a registered office at 341, Strickland House, St. Paul’s Street, Valletta ("we", "us", "our").  Through the Website we sell priced products, as well as services (“Allied’s Online Shop”).

 

2. General conditions of dissemination and sale

These conditions apply to all priced products (hereafter called "publications") and services (such as "newspapers subscriptions") offered via Allied’s Online Shop.

3. Orders

Allied’s Online Shop will only accept and process orders you make online.

The steps for placing your order are validated in successive screens. Until the final validation, you can cancel your order at any point in time. When you submit an order, please make note of the order number that appears on the screen.

If you don't receive electronic confirmation of your order and its details within 24 hours, please contact us via email on [email protected] and quote this order number. If publications are unavailable or your order cannot be fulfilled for any other reason, you will be notified in a separate e-mail. In order for orders to be fulfilled, you are required to be registered and you will need to login on Allied’s Online Shop using your personal credentials (username and password). All your order data is automatically saved in an area designated as your "Order History", visible once you login.

You shall be solely responsible for maintaining the confidentiality of your password and account details, and you are under no obligation to reveal it to any representative of Allied’s Online Shop. You are therefore solely and exclusively responsible for all transactions under your account name and password.

Allied’s Online Shop reserves the right, and you accept, to terminate an account for any reason, without liability.

4. Availability of Publications

The publications in stock are marked by a blue button “Buy Now” in their detail page. If stocks change by the time we receive and process your order, or if a title becomes unavailable suddenly, we will inform you by e-mail. Out of stock items will be marked by a blue button “Out of Stock”.

If the publications you have ordered and paid for remain unavailable, you will be refunded within thirty (30) days.

Allied’s Online Shop reserves the right, and you accept to cancel any orders at its sole and exclusive discretion, without liability and without an obligation to assign any reason to you. In the event of a cancellation of an order by Allied’s Online Shop you will be refunded in full for the value of the order within fourteen (14) days.

Allied’s Online Shop reserves the right, and you accept, to change at any time and without notice, the price of any publications or subscriptions.

5. Delivery

The publications will be delivered to the postal address given in your order form and stored in your account. Alternatively if you opt to pick up the item, you may do so from the following address:

Allied’s Online Shop cannot be held responsible for unsolicited orders of publications made by a user on behalf of (and/or delivered to) another person (recipient). In the event of suspected misuse or abuse of the online order facility, Allied Bookshop reserves the right to block or amend these orders and deliveries. Orders will processed on the next business day and shipments shall be effected within two days provided the item is in stock.

Allied’s Online Shop cannot be held responsible for the consequences of any delay in delivery particularly due to force majeure, such as computer breakdown, disruption or strikes affecting postal services.

6. Damage or loss in transit

Allied’s Online Shop will replace at no extra cost any publication(s) lost or damaged on or before delivery, if you notify us in writing, with appropriate supporting evidence. For damaged publication(s), please notify us as soon as reasonably possible after receipt.

7. Returns and reimbursements

To return an item, you must e-mail us within fifteen (15) calendar days of receipt and return it within fifteen (15) calendar days of sending your e-mail. You do not need to give any reason for returning the item, provided that you do so within this deadline and provided that the item is returned in the same condition that it was sent to you. We will reimburse your payment by crediting your credit card no later than fifteen (15) calendar days from the day on which you e-mailed us. However, we may withhold reimbursement until we have received the item or you have supplied evidence of having returned it. You will have to bear only the cost of returning the item. Returned items must be sent to the following address:

The return policy above shall not apply on the sale of periodicals, newspapers or magazines.

8. Price policy, payment, VAT and custom duties

All prices are per unit and in euro. They are quoted inclusive of value-added tax (VAT).

Customs duty and other taxes may be levied on sales and shipping outside the EU. These duties and taxes are to be paid by the customer, who is entirely responsible for both declaration and payment to the responsible authorities in the country concerned.

The rates for postage are dynamically and automatically calculated through an automated service offered by Maltapost. They reflect the costs incurred by Allied’s Online Shop for providing these services and will be reviewed periodically. Payment is due at the time of ordering and should be made by one of the credit cards accepted by Transactium, the payment gateway company who securely handle all electronic payments for Allied’s Online Shop.

9. Protection of personal data

Allied Newspapers Ltd privacy policy states what information is collected and used by us for the needs of sales and dissemination activities, and under what circumstances, if any, we will share it with other parties.

10. Disclaimer of Warranties and limitation of liability

You agree that your access to, and use of Allied’s Online Shop and any of our services is entirely at your own risk and the service is provided on an as-is basis without any warranties of any kind. Allied’s Online Shop hereby specifically disclaims any representation or warranties, express or implied. Moreover Allied’s Online Shop expressly disclaims any warranties for any publications, services goods received through or advertised on its website. It is therefore your responsibility to verify that any information is accurate. We are moreover not responsible for any losses or damage, whether direct or indirect, resulting from use of our services and even if such losses result from a deliberate breach of these terms by us that would entitle you to terminate your agreement between us, and in any event, our liability as a result of us breaking any of these terms is strictly limited to the charges you have paid (if any) for any of our paid services or the publications. We disclaim any warranties for viruses or other harmful components in connection with the use of our site or its services.

11. Indemnity

You agree to indemnify and hold us, including any of our officers, employees, agents and representatives, harmless from and against any and all claims or demand, including reasonable advocate fees and court costs made by any third party due to or arising of your violation of the use of Allied’s Online Shop, its general conditions and privacy policy.

12. Disputes and applicable law

Our aim is to settle any disputes amicably in the framework of these general conditions of dissemination and sale. Please send any questions or complaints to [email protected]

These general conditions are governed by the laws of Malta. 

The Maltese courts shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with this contract, or the breach, termination or invalidity thereof. If any part or provision is found to be unlawful or unenforceable, this shall not affect the validity of any other provisions.
